These General Terms and Conditions (GTC) apply to all business relationships between Kuckein Consulting – Kai Kuckein, Lutherstr. 9, 65203 Wiesbaden, Germany (hereinafter "Provider") and the customer. Deviating GTC of the customer shall not be recognized unless the Provider expressly agrees to their validity in writing.
The Provider offers the macOS application "OnWhispr" for local speech-to-text processing. The software is distributed as a one-time purchase via the Mac App Store. A free version with limited functionality is available.
The contract is concluded by purchasing the software via the Mac App Store. Apple's terms of use also apply.
The price for the full version is €79 (one-time). Payment is processed through the Mac App Store. All prices are final prices including statutory VAT.
OnWhispr processes all data exclusively locally on the customer's device. No voice or text data is transmitted to servers. The software requires no internet connection after the initial download of AI models.
Statutory warranty rights apply. The Provider warrants that the software is free from material and legal defects at the time of delivery. The warranty period is two years from the date of purchase.
The Provider is liable without limitation for intent and gross negligence. For slight negligence, the Provider is only liable for breach of material contractual obligations. In this case, liability is limited to the foreseeable, typically occurring damage. Liability for damages arising from injury to life, body or health remains unaffected.
The law of the Federal Republic of Germany applies. The place of jurisdiction, insofar as legally permissible, is Wiesbaden. Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
